  現將(jiang)《土壤污(wu)染防治行動計劃》印發給你們,請認(ren)真貫徹執行。

  土壤污染防治(zhi)行動(dong)計劃

  土(tu)(tu)壤(rang)(rang)是經濟社(she)(she)會(hui)可持(chi)續(xu)發(fa)展(zhan)的物(wu)質基(ji)礎,關(guan)系(xi)(xi)人民(min)群眾身體(ti)健康(kang),關(guan)系(xi)(xi)美(mei)麗中國(guo)建設,保護好土(tu)(tu)壤(rang)(rang)環境是推進生(sheng)態文明建設和維護國(guo)家生(sheng)態安全的重要內(nei)容。當(dang)前,我(wo)國(guo)土(tu)(tu)壤(rang)(rang)環境總體(ti)狀況(kuang)堪憂,部分地區污染較(jiao)為(wei)嚴(yan)重,已成為(wei)全面建成小康(kang)社(she)(she)會(hui)的突出(chu)短(duan)板之(zhi)一。為(wei)切實加強土(tu)(tu)壤(rang)(rang)污染防(fang)治,逐步改善土(tu)(tu)壤(rang)(rang)環境質量,制定本(ben)行(xing)動計劃。

  總體(ti)要(yao)求:全面貫(guan)徹黨的(de)十(shi)八大和(he)(he)十(shi)八屆三(san)中(zhong)(zhong)、四中(zhong)(zhong)、五中(zhong)(zhong)全會(hui)精神,按照“五位一(yi)體(ti)”總體(ti)布(bu)局和(he)(he)“四個全面”戰(zhan)略布(bu)局,牢(lao)固樹立創新、協(xie)調、綠色、開放、共享的(de)新發(fa)展(zhan)(zhan)理念,認真落(luo)實(shi)黨中(zhong)(zhong)央、國(guo)務(wu)院決策(ce)部署,立足我國(guo)國(guo)情和(he)(he)發(fa)展(zhan)(zhan)階(jie)(jie)段,著(zhu)眼(yan)經濟(ji)社(she)會(hui)發(fa)展(zhan)(zhan)全局,以改善土壤(rang)環境質(zhi)量為(wei)核(he)心(xin),以保(bao)(bao)障農產品質(zhi)量和(he)(he)人居環境安(an)全為(wei)出發(fa)點,堅持(chi)預防為(wei)主、保(bao)(bao)護優先、風險(xian)管(guan)控(kong),突出重點區域、行業和(he)(he)污染物,實(shi)施分(fen)類別(bie)、分(fen)用(yong)途、分(fen)階(jie)(jie)段治(zhi)(zhi)理,嚴(yan)控(kong)新增污染、逐步減少存(cun)量,形成政府主導、企業擔(dan)責、公眾(zhong)參與(yu)、社(she)會(hui)監督(du)的(de)土壤(rang)污染防治(zhi)(zhi)體(ti)系,促進土壤(rang)資源永續(xu)利用(yong),為(wei)建(jian)設“藍(lan)天(tian)常(chang)(chang)在(zai)、青山常(chang)(chang)在(zai)、綠水常(chang)(chang)在(zai)”的(de)美(mei)麗中(zhong)(zhong)國(guo)而奮斗。

  工作目標:到(dao)(dao)2020年,全(quan)國土(tu)(tu)壤(rang)污染(ran)加重趨勢得(de)到(dao)(dao)初步遏制,土(tu)(tu)壤(rang)環境(jing)(jing)質(zhi)量(liang)總體保持穩(wen)定,農用(yong)地(di)和(he)建(jian)設用(yong)地(di)土(tu)(tu)壤(rang)環境(jing)(jing)安全(quan)得(de)到(dao)(dao)基本保障,土(tu)(tu)壤(rang)環境(jing)(jing)風險(xian)得(de)到(dao)(dao)基本管控。到(dao)(dao)2030年,全(quan)國土(tu)(tu)壤(rang)環境(jing)(jing)質(zhi)量(liang)穩(wen)中向好,農用(yong)地(di)和(he)建(jian)設用(yong)地(di)土(tu)(tu)壤(rang)環境(jing)(jing)安全(quan)得(de)到(dao)(dao)有效保障,土(tu)(tu)壤(rang)環境(jing)(jing)風險(xian)得(de)到(dao)(dao)全(quan)面管控。到(dao)(dao)本世紀中葉(xie),土(tu)(tu)壤(rang)環境(jing)(jing)質(zhi)量(liang)全(quan)面改善,生態(tai)系統(tong)實現(xian)良性循環。

  主(zhu)要指標:到(dao)(dao)(dao)2020年(nian),受污染(ran)耕地安全(quan)(quan)利(li)(li)用(yong)率達(da)到(dao)(dao)(dao)90%左右,污染(ran)地塊安全(quan)(quan)利(li)(li)用(yong)率達(da)到(dao)(dao)(dao)90%以上(shang)(shang)。到(dao)(dao)(dao)2030年(nian),受污染(ran)耕地安全(quan)(quan)利(li)(li)用(yong)率達(da)到(dao)(dao)(dao)95%以上(shang)(shang),污染(ran)地塊安全(quan)(quan)利(li)(li)用(yong)率達(da)到(dao)(dao)(dao)95%以上(shang)(shang)。

  

土壤污染防治行動計劃

 

  一、開展土壤污染調查,掌握土壤環境質量狀況

  (一)深入開(kai)展(zhan)土(tu)(tu)(tu)(tu)壤(rang)環(huan)境質(zhi)量(liang)調查(cha)(cha)。在現有相關調查(cha)(cha)基(ji)礎上,以農用(yong)地(di)(di)和(he)(he)重點行業(ye)企業(ye)用(yong)地(di)(di)為重點,開(kai)展(zhan)土(tu)(tu)(tu)(tu)壤(rang)污染(ran)狀況(kuang)詳查(cha)(cha),2018年底前查(cha)(cha)明農用(yong)地(di)(di)土(tu)(tu)(tu)(tu)壤(rang)污染(ran)的(de)面積(ji)、分布及其對農產品(pin)質(zhi)量(liang)的(de)影(ying)響;2020年底前掌(zhang)握重點行業(ye)企業(ye)用(yong)地(di)(di)中的(de)污染(ran)地(di)(di)塊分布及其環(huan)境風險情況(kuang)。制定(ding)詳查(cha)(cha)總體方案(an)和(he)(he)技(ji)術規定(ding),開(kai)展(zhan)技(ji)術指導、監督檢查(cha)(cha)和(he)(he)成果審核。建(jian)立(li)土(tu)(tu)(tu)(tu)壤(rang)環(huan)境質(zhi)量(liang)狀況(kuang)定(ding)期調查(cha)(cha)制度,每(mei)10年開(kai)展(zhan)1次。(環(huan)境保護(hu)部(bu)(bu)牽頭,財政(zheng)部(bu)(bu)、國(guo)土(tu)(tu)(tu)(tu)資(zi)源部(bu)(bu)、農業(ye)部(bu)(bu)、國(guo)家衛(wei)生(sheng)計生(sheng)委等參(can)與,地(di)(di)方各級(ji)人(ren)民政(zheng)府負責落(luo)實。以下均需(xu)地(di)(di)方各級(ji)人(ren)民政(zheng)府落(luo)實,不再(zai)列出)

  (二)建設土(tu)(tu)(tu)壤環(huan)境(jing)質(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)網絡。統一規(gui)劃、整合優化(hua)土(tu)(tu)(tu)壤環(huan)境(jing)質(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)點(dian)位(wei),2017年底(di)(di)前(qian),完(wan)成土(tu)(tu)(tu)壤環(huan)境(jing)質(zhi)量(liang)國(guo)(guo)控監(jian)(jian)(jian)測(ce)(ce)(ce)點(dian)位(wei)設置,建成國(guo)(guo)家土(tu)(tu)(tu)壤環(huan)境(jing)質(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)網絡,充分發揮行業監(jian)(jian)(jian)測(ce)(ce)(ce)網作用,基本形成土(tu)(tu)(tu)壤環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)能力。各省(sheng)(區、市)每(mei)年至(zhi)少開(kai)展1次(ci)土(tu)(tu)(tu)壤環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)技術(shu)人員培(pei)訓。各地可(ke)根據工作需要,補充設置監(jian)(jian)(jian)測(ce)(ce)(ce)點(dian)位(wei),增(zeng)加特(te)征污(wu)染(ran)物監(jian)(jian)(jian)測(ce)(ce)(ce)項目,提高監(jian)(jian)(jian)測(ce)(ce)(ce)頻次(ci)。2020年底(di)(di)前(qian),實現(xian)土(tu)(tu)(tu)壤環(huan)境(jing)質(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)點(dian)位(wei)所有縣(xian)(市、區)全覆蓋(gai)。(環(huan)境(jing)保護部(bu)(bu)牽頭,國(guo)(guo)家發展改革委、工業和信(xin)息化(hua)部(bu)(bu)、國(guo)(guo)土(tu)(tu)(tu)資源部(bu)(bu)、農業部(bu)(bu)等(deng)參與(yu))

  (三)提升土(tu)壤環(huan)境(jing)信息化(hua)管理水(shui)平。利(li)用環(huan)境(jing)保護、國(guo)土(tu)資(zi)源、農業(ye)(ye)等(deng)(deng)(deng)部(bu)(bu)門相關數(shu)據,建立(li)土(tu)壤環(huan)境(jing)基礎數(shu)據庫,構建全國(guo)土(tu)壤環(huan)境(jing)信息化(hua)管理平臺,力爭2018年(nian)底前完成。借(jie)助移(yi)動(dong)互聯(lian)網、物聯(lian)網等(deng)(deng)(deng)技術,拓寬(kuan)數(shu)據獲取渠道,實現數(shu)據動(dong)態(tai)更(geng)新。加強數(shu)據共享,編制資(zi)源共享目錄,明確(que)共享權限和方(fang)式,發揮土(tu)壤環(huan)境(jing)大數(shu)據在污(wu)染防治、城鄉規劃(hua)、土(tu)地利(li)用、農業(ye)(ye)生(sheng)產中的作(zuo)用。(環(huan)境(jing)保護部(bu)(bu)牽頭,國(guo)家發展改革委、教育部(bu)(bu)、科技部(bu)(bu)、工業(ye)(ye)和信息化(hua)部(bu)(bu)、國(guo)土(tu)資(zi)源部(bu)(bu)、住房城鄉建設(she)部(bu)(bu)、農業(ye)(ye)部(bu)(bu)、國(guo)家衛生(sheng)計(ji)生(sheng)委、國(guo)家林(lin)業(ye)(ye)局等(deng)(deng)(deng)參與)

  二、推進土(tu)壤污(wu)染(ran)防治(zhi)立法,建立健全法規標準體(ti)系(xi)

  (四(si))加(jia)快推進立法(fa)(fa)(fa)(fa)進程。配合完成土(tu)壤(rang)污(wu)染(ran)(ran)(ran)防治法(fa)(fa)(fa)(fa)起草工作。適時修訂污(wu)染(ran)(ran)(ran)防治、城鄉規劃、土(tu)地管理(li)、農產品質量安全相關法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規,增加(jia)土(tu)壤(rang)污(wu)染(ran)(ran)(ran)防治有關內容(rong)。2016年底(di)前,完成農藥管理(li)條例修訂工作,發(fa)布污(wu)染(ran)(ran)(ran)地塊土(tu)壤(rang)環(huan)(huan)(huan)(huan)境(jing)管理(li)辦(ban)法(fa)(fa)(fa)(fa)、農用(yong)地土(tu)壤(rang)環(huan)(huan)(huan)(huan)境(jing)管理(li)辦(ban)法(fa)(fa)(fa)(fa)。2017年底(di)前,出臺農藥包(bao)裝廢棄物回收處(chu)理(li)、工礦用(yong)地土(tu)壤(rang)環(huan)(huan)(huan)(huan)境(jing)管理(li)、廢棄農膜回收利用(yong)等(deng)部門(men)規章。到2020年,土(tu)壤(rang)污(wu)染(ran)(ran)(ran)防治法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規體系基本建(jian)立。各地可結(jie)合實際,研(yan)究(jiu)制定(ding)土(tu)壤(rang)污(wu)染(ran)(ran)(ran)防治地方性法(fa)(fa)(fa)(fa)規。(國務院法(fa)(fa)(fa)(fa)制辦(ban)、環(huan)(huan)(huan)(huan)境(jing)保護部牽頭,工業(ye)和信(xin)息化(hua)部、國土(tu)資源部、住(zhu)房(fang)城鄉建(jian)設部、農業(ye)部、國家林業(ye)局等(deng)參與)

  (五)系統構建標(biao)(biao)準(zhun)體系。健全(quan)土(tu)(tu)壤(rang)(rang)污(wu)(wu)(wu)(wu)染(ran)(ran)防治相關(guan)標(biao)(biao)準(zhun)和技(ji)(ji)術規范(fan)。2017年底前(qian),發布農(nong)(nong)用(yong)地(di)(di)、建設(she)用(yong)地(di)(di)土(tu)(tu)壤(rang)(rang)環(huan)境(jing)(jing)(jing)質(zhi)量(liang)標(biao)(biao)準(zhun);完(wan)成土(tu)(tu)壤(rang)(rang)環(huan)境(jing)(jing)(jing)監測、調查評(ping)(ping)估、風險(xian)管控(kong)、治理與(yu)修(xiu)復等技(ji)(ji)術規范(fan)以及環(huan)境(jing)(jing)(jing)影響(xiang)評(ping)(ping)價技(ji)(ji)術導則制(zhi)修(xiu)訂(ding)(ding)工(gong)作;修(xiu)訂(ding)(ding)肥料(liao)(liao)、飼料(liao)(liao)、灌(guan)溉用(yong)水(shui)中有毒有害物質(zhi)限量(liang)和農(nong)(nong)用(yong)污(wu)(wu)(wu)(wu)泥中污(wu)(wu)(wu)(wu)染(ran)(ran)物控(kong)制(zhi)等標(biao)(biao)準(zhun),進一步嚴格污(wu)(wu)(wu)(wu)染(ran)(ran)物控(kong)制(zhi)要(yao)求;修(xiu)訂(ding)(ding)農(nong)(nong)膜(mo)標(biao)(biao)準(zhun),提高厚度要(yao)求,研(yan)究(jiu)制(zhi)定可(ke)降解農(nong)(nong)膜(mo)標(biao)(biao)準(zhun);修(xiu)訂(ding)(ding)農(nong)(nong)藥包(bao)裝(zhuang)標(biao)(biao)準(zhun),增加(jia)防止(zhi)農(nong)(nong)藥包(bao)裝(zhuang)廢棄物污(wu)(wu)(wu)(wu)染(ran)(ran)土(tu)(tu)壤(rang)(rang)的要(yao)求。適時修(xiu)訂(ding)(ding)污(wu)(wu)(wu)(wu)染(ran)(ran)物排(pai)放(fang)標(biao)(biao)準(zhun),進一步明確污(wu)(wu)(wu)(wu)染(ran)(ran)物特(te)別(bie)排(pai)放(fang)限值要(yao)求。完(wan)善(shan)土(tu)(tu)壤(rang)(rang)中污(wu)(wu)(wu)(wu)染(ran)(ran)物分析(xi)測試方法(fa),研(yan)制(zhi)土(tu)(tu)壤(rang)(rang)環(huan)境(jing)(jing)(jing)標(biao)(biao)準(zhun)樣品。各地(di)(di)可(ke)制(zhi)定嚴于國(guo)家(jia)(jia)標(biao)(biao)準(zhun)的地(di)(di)方土(tu)(tu)壤(rang)(rang)環(huan)境(jing)(jing)(jing)質(zhi)量(liang)標(biao)(biao)準(zhun)。(環(huan)境(jing)(jing)(jing)保護部(bu)牽頭,工(gong)業(ye)和信息化(hua)部(bu)、國(guo)土(tu)(tu)資(zi)源(yuan)部(bu)、住房城鄉建設(she)部(bu)、水(shui)利部(bu)、農(nong)(nong)業(ye)部(bu)、質(zhi)檢總局、國(guo)家(jia)(jia)林業(ye)局等參(can)與(yu))

  (六)全(quan)面(mian)強化(hua)監管執法(fa)。明確監管重點(dian)。重點(dian)監測土(tu)壤(rang)中鎘(ge)、汞(gong)、砷、鉛、鉻等重金(jin)(jin)屬和多環芳(fang)烴(jing)、石油烴(jing)等有(you)機(ji)污染物,重點(dian)監管有(you)色金(jin)(jin)屬礦采選(xuan)、有(you)色金(jin)(jin)屬冶煉、石油開采、石油加工(gong)、化(hua)工(gong)、焦(jiao)化(hua)、電鍍、制革(ge)等行業(ye),以及(ji)產糧(油)大縣、地級以上城市(shi)建(jian)成區(qu)(qu)等區(qu)(qu)域。(環境保護(hu)部(bu)牽頭,工(gong)業(ye)和信息化(hua)部(bu)、國土(tu)資源部(bu)、住房城鄉建(jian)設(she)部(bu)、農業(ye)部(bu)等參與(yu))

  

土壤污染防治行動計劃

 

  加大執法(fa)力度(du)。將(jiang)土(tu)壤污(wu)(wu)(wu)染(ran)防治(zhi)作(zuo)為(wei)環(huan)境(jing)執法(fa)的(de)重要內(nei)容,充分(fen)利用(yong)環(huan)境(jing)監(jian)(jian)管網格,加強(qiang)土(tu)壤環(huan)境(jing)日常(chang)監(jian)(jian)管執法(fa)。嚴(yan)厲打擊非法(fa)排放有毒有害(hai)污(wu)(wu)(wu)染(ran)物、違(wei)法(fa)違(wei)規存放危險化(hua)學品(pin)、非法(fa)處置(zhi)危險廢(fei)物、不(bu)正常(chang)使用(yong)污(wu)(wu)(wu)染(ran)治(zhi)理設(she)施、監(jian)(jian)測數據弄(nong)虛作(zuo)假等(deng)環(huan)境(jing)違(wei)法(fa)行為(wei)。開(kai)展(zhan)重點行業企(qi)業專項環(huan)境(jing)執法(fa),對嚴(yan)重污(wu)(wu)(wu)染(ran)土(tu)壤環(huan)境(jing)、群(qun)眾反映強(qiang)烈的(de)企(qi)業進行掛牌督(du)辦。改善(shan)基(ji)層(ceng)環(huan)境(jing)執法(fa)條(tiao)件(jian),配(pei)備必要的(de)土(tu)壤污(wu)(wu)(wu)染(ran)快速檢測等(deng)執法(fa)裝備。對全國環(huan)境(jing)執法(fa)人員(yuan)每3年開(kai)展(zhan)1輪土(tu)壤污(wu)(wu)(wu)染(ran)防治(zhi)專業技術(shu)培(pei)訓。提(ti)高突(tu)發環(huan)境(jing)事件(jian)應急能力,完善(shan)各級環(huan)境(jing)污(wu)(wu)(wu)染(ran)事件(jian)應急預案,加強(qiang)環(huan)境(jing)應急管理、技術(shu)支撐、處置(zhi)救援能力建設(she)。(環(huan)境(jing)保護部(bu)(bu)牽頭,工業和信息化(hua)部(bu)(bu)、公安部(bu)(bu)、國土(tu)資源部(bu)(bu)、住房(fang)城鄉(xiang)建設(she)部(bu)(bu)、農業部(bu)(bu)、安全監(jian)(jian)管總局(ju)、國家(jia)林業局(ju)等(deng)參與)

  三、實施農用地(di)分類管理,保(bao)障農業(ye)生(sheng)產環境安(an)全

  (七)劃(hua)(hua)(hua)(hua)定農(nong)(nong)用(yong)(yong)地(di)(di)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)質(zhi)量(liang)(liang)類(lei)別(bie)。按(an)污(wu)染(ran)(ran)程度(du)將農(nong)(nong)用(yong)(yong)地(di)(di)劃(hua)(hua)(hua)(hua)為(wei)(wei)三(san)個類(lei)別(bie),未污(wu)染(ran)(ran)和(he)輕微污(wu)染(ran)(ran)的(de)劃(hua)(hua)(hua)(hua)為(wei)(wei)優先保護(hu)(hu)類(lei),輕度(du)和(he)中度(du)污(wu)染(ran)(ran)的(de)劃(hua)(hua)(hua)(hua)為(wei)(wei)安全(quan)利用(yong)(yong)類(lei),重(zhong)度(du)污(wu)染(ran)(ran)的(de)劃(hua)(hua)(hua)(hua)為(wei)(wei)嚴格管控類(lei),以耕地(di)(di)為(wei)(wei)重(zhong)點,分別(bie)采取相應管理措(cuo)施,保障農(nong)(nong)產品質(zhi)量(liang)(liang)安全(quan)。2017年(nian)底(di)前(qian),發布(bu)農(nong)(nong)用(yong)(yong)地(di)(di)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)質(zhi)量(liang)(liang)類(lei)別(bie)劃(hua)(hua)(hua)(hua)分技術指(zhi)南。以土(tu)壤(rang)(rang)污(wu)染(ran)(ran)狀(zhuang)況詳查結果(guo)為(wei)(wei)依據(ju),開(kai)展(zhan)耕地(di)(di)土(tu)壤(rang)(rang)和(he)農(nong)(nong)產品協同監測與評(ping)價,在試點基礎上有序(xu)推進耕地(di)(di)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)質(zhi)量(liang)(liang)類(lei)別(bie)劃(hua)(hua)(hua)(hua)定,逐步(bu)建(jian)立分類(lei)清單,2020年(nian)底(di)前(qian)完成。劃(hua)(hua)(hua)(hua)定結果(guo)由各省級人民(min)政府(fu)審定,數據(ju)上傳全(quan)國(guo)(guo)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)信息化管理平(ping)臺。根(gen)據(ju)土(tu)地(di)(di)利用(yong)(yong)變更(geng)和(he)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)質(zhi)量(liang)(liang)變化情況,定期對各類(lei)別(bie)耕地(di)(di)面積、分布(bu)等(deng)(deng)信息進行更(geng)新。有條件(jian)的(de)地(di)(di)區要逐步(bu)開(kai)展(zhan)林地(di)(di)、草地(di)(di)、園地(di)(di)等(deng)(deng)其他農(nong)(nong)用(yong)(yong)地(di)(di)土(tu)壤(rang)(rang)環(huan)(huan)(huan)(huan)境(jing)(jing)質(zhi)量(liang)(liang)類(lei)別(bie)劃(hua)(hua)(hua)(hua)定等(deng)(deng)工作(zuo)。(環(huan)(huan)(huan)(huan)境(jing)(jing)保護(hu)(hu)部(bu)、農(nong)(nong)業部(bu)牽頭,國(guo)(guo)土(tu)資(zi)源(yuan)部(bu)、國(guo)(guo)家林業局等(deng)(deng)參(can)與)

  (八(ba))切實(shi)加(jia)大(da)保護(hu)(hu)(hu)力度。各地(di)(di)要(yao)將符合條件的(de)優先保護(hu)(hu)(hu)類耕(geng)(geng)地(di)(di)劃(hua)為永久基(ji)本農(nong)田(tian),實(shi)行嚴(yan)格保護(hu)(hu)(hu),確(que)(que)保其面積不減(jian)少(shao)、土壤環(huan)(huan)境(jing)(jing)質量不下(xia)降,除法律(lv)規定(ding)的(de)重點建(jian)設項(xiang)目(mu)選址確(que)(que)實(shi)無法避(bi)讓(rang)外,其他任何建(jian)設不得占用(yong)。產糧(油)大(da)縣要(yao)制定(ding)土壤環(huan)(huan)境(jing)(jing)保護(hu)(hu)(hu)方案。高標準農(nong)田(tian)建(jian)設項(xiang)目(mu)向(xiang)優先保護(hu)(hu)(hu)類耕(geng)(geng)地(di)(di)集中的(de)地(di)(di)區(qu)傾斜(xie)。推行秸稈還田(tian)、增施(shi)有(you)機肥(fei)、少(shao)耕(geng)(geng)免(mian)(mian)耕(geng)(geng)、糧豆輪作、農(nong)膜減(jian)量與(yu)回收利(li)(li)用(yong)等措(cuo)施(shi)。繼續開展黑土地(di)(di)保護(hu)(hu)(hu)利(li)(li)用(yong)試點。農(nong)村土地(di)(di)流轉(zhuan)的(de)受讓(rang)方要(yao)履(lv)行土壤保護(hu)(hu)(hu)的(de)責任,避(bi)免(mian)(mian)因(yin)過度施(shi)肥(fei)、濫(lan)用(yong)農(nong)藥等掠奪式農(nong)業(ye)生(sheng)產方式造成(cheng)土壤環(huan)(huan)境(jing)(jing)質量下(xia)降。各省級人(ren)民政府要(yao)對本行政區(qu)域(yu)內優先保護(hu)(hu)(hu)類耕(geng)(geng)地(di)(di)面積減(jian)少(shao)或(huo)土壤環(huan)(huan)境(jing)(jing)質量下(xia)降的(de)縣(市、區(qu)),進行預警提醒(xing)并(bing)依法采取環(huan)(huan)評限(xian)批(pi)等限(xian)制性措(cuo)施(shi)。(國土資源(yuan)部(bu)(bu)、農(nong)業(ye)部(bu)(bu)牽頭,國家發展改(gai)革委、環(huan)(huan)境(jing)(jing)保護(hu)(hu)(hu)部(bu)(bu)、水(shui)利(li)(li)部(bu)(bu)等參與(yu))

土壤污染防治行動計劃

 

  (九)著力推進安(an)(an)(an)全利(li)用(yong)(yong)。根據土(tu)(tu)壤污染狀況(kuang)和(he)(he)農(nong)產(chan)(chan)品超標情(qing)況(kuang),安(an)(an)(an)全利(li)用(yong)(yong)類(lei)耕地集中的(de)縣(市、區)要(yao)結合當地主要(yao)作物品種和(he)(he)種植(zhi)習慣(guan),制定實(shi)施受(shou)污染耕地安(an)(an)(an)全利(li)用(yong)(yong)方案,采取(qu)農(nong)藝調控、替代種植(zhi)等措施,降低農(nong)產(chan)(chan)品超標風險。強(qiang)化農(nong)產(chan)(chan)品質量(liang)檢測。加(jia)強(qiang)對(dui)農(nong)民、農(nong)民合作社的(de)技術(shu)指導和(he)(he)培(pei)訓。2017年(nian)底前,出臺受(shou)污染耕地安(an)(an)(an)全利(li)用(yong)(yong)技術(shu)指南(nan)。到(dao)2020年(nian),輕(qing)度和(he)(he)中度污染耕地實(shi)現安(an)(an)(an)全利(li)用(yong)(yong)的(de)面積達到(dao)4000萬畝。(農(nong)業(ye)部牽頭,國(guo)土(tu)(tu)資源部等參(can)與)

  (十)全(quan)面落實(shi)嚴格管(guan)控。加強對嚴格管(guan)控類耕(geng)(geng)地的(de)用途管(guan)理,依法劃定特定農(nong)(nong)產(chan)品(pin)禁止生產(chan)區域,嚴禁種(zhong)(zhong)植(zhi)食(shi)用農(nong)(nong)產(chan)品(pin);對威脅地下水、飲用水水源(yuan)安全(quan)的(de),有關(guan)縣(市、區)要制(zhi)定環境(jing)風險管(guan)控方(fang)案,并落實(shi)有關(guan)措(cuo)施(shi)。研究將嚴格管(guan)控類耕(geng)(geng)地納入國家新一輪(lun)退(tui)耕(geng)(geng)還(huan)林還(huan)草實(shi)施(shi)范圍,制(zhi)定實(shi)施(shi)重度污染(ran)耕(geng)(geng)地種(zhong)(zhong)植(zhi)結構(gou)調整(zheng)或(huo)退(tui)耕(geng)(geng)還(huan)林還(huan)草計劃。繼續在湖(hu)南長株潭地區開展(zhan)重金(jin)屬污染(ran)耕(geng)(geng)地修復及(ji)農(nong)(nong)作物種(zhong)(zhong)植(zhi)結構(gou)調整(zheng)試(shi)點。實(shi)行耕(geng)(geng)地輪(lun)作休耕(geng)(geng)制(zhi)度試(shi)點。到(dao)2020年(nian),重度污染(ran)耕(geng)(geng)地種(zhong)(zhong)植(zhi)結構(gou)調整(zheng)或(huo)退(tui)耕(geng)(geng)還(huan)林還(huan)草面積力爭達到(dao)2000萬畝。(農(nong)(nong)業(ye)部牽頭,國家發(fa)展(zhan)改革(ge)委、財政部、國土資源(yuan)部、環境(jing)保護(hu)部、水利部、國家林業(ye)局參與)

  (十一)加強林地(di)草(cao)地(di)園地(di)土壤環境管(guan)理。嚴格控制林地(di)、草(cao)地(di)、園地(di)的(de)(de)農藥(yao)使(shi)用量,禁止使(shi)用高毒、高殘(can)留農藥(yao)。完善生(sheng)物農藥(yao)、引誘(you)劑管(guan)理制度(du)(du),加大使(shi)用推(tui)廣力度(du)(du)。優先(xian)將重度(du)(du)污染的(de)(de)牧草(cao)地(di)集中區域納入(ru)禁牧休牧實(shi)施范圍。加強對重度(du)(du)污染林地(di)、園地(di)產(chan)(chan)出食用農(林)產(chan)(chan)品質(zhi)量檢測,發現超標的(de)(de),要采取種植結構調整(zheng)等措施。(農業部(bu)、國家林業局負責)

  四、實施建設用地準入管理(li),防范人居(ju)環境風險

  (十二)明確管理要求(qiu)。建立調查評(ping)(ping)(ping)估(gu)(gu)制度(du)。2016年底前,發布建設用(yong)(yong)地(di)土(tu)壤環(huan)境調查評(ping)(ping)(ping)估(gu)(gu)技(ji)術規(gui)定。自2017年起,對擬(ni)收回土(tu)地(di)使(shi)用(yong)(yong)權(quan)的(de)(de)(de)有色金屬冶煉、石油加(jia)工、化工、焦化、電鍍(du)、制革等行業企(qi)業用(yong)(yong)地(di),以及用(yong)(yong)途擬(ni)變更為居住(zhu)和商業、學校、醫療、養老(lao)機構等公共設施的(de)(de)(de)上述企(qi)業用(yong)(yong)地(di),由(you)(you)土(tu)地(di)使(shi)用(yong)(yong)權(quan)人負責(ze)開(kai)展土(tu)壤環(huan)境狀況調查評(ping)(ping)(ping)估(gu)(gu);已經收回的(de)(de)(de),由(you)(you)所在(zai)地(di)市、縣(xian)(xian)級人民(min)政府(fu)負責(ze)開(kai)展調查評(ping)(ping)(ping)估(gu)(gu)。自2018年起,重(zhong)度(du)污染農用(yong)(yong)地(di)轉為城(cheng)鎮建設用(yong)(yong)地(di)的(de)(de)(de),由(you)(you)所在(zai)地(di)市、縣(xian)(xian)級人民(min)政府(fu)負責(ze)組織(zhi)開(kai)展調查評(ping)(ping)(ping)估(gu)(gu)。調查評(ping)(ping)(ping)估(gu)(gu)結果向所在(zai)地(di)環(huan)境保護、城(cheng)鄉規(gui)劃、國土(tu)資源部(bu)門備(bei)案。(環(huan)境保護部(bu)牽頭,國土(tu)資源部(bu)、住(zhu)房城(cheng)鄉建設部(bu)參與)

  分用(yong)途明確管(guan)理(li)措(cuo)施。自2017年(nian)起,各地(di)(di)(di)(di)要(yao)結合土壤污(wu)(wu)染(ran)(ran)狀況(kuang)詳查情況(kuang),根據建設(she)用(yong)地(di)(di)(di)(di)土壤環境(jing)調查評估結果,逐步建立(li)污(wu)(wu)染(ran)(ran)地(di)(di)(di)(di)塊(kuai)名錄及其開(kai)發利(li)(li)用(yong)的(de)(de)(de)負面(mian)清單(dan),合理(li)確定土地(di)(di)(di)(di)用(yong)途。符(fu)合相(xiang)應規劃(hua)用(yong)地(di)(di)(di)(di)土壤環境(jing)質(zhi)量要(yao)求的(de)(de)(de)地(di)(di)(di)(di)塊(kuai),可進入用(yong)地(di)(di)(di)(di)程序。暫(zan)不開(kai)發利(li)(li)用(yong)或現階段(duan)不具備治理(li)修復條件的(de)(de)(de)污(wu)(wu)染(ran)(ran)地(di)(di)(di)(di)塊(kuai),由所在地(di)(di)(di)(di)縣(xian)級人民政府組(zu)織劃(hua)定管(guan)控區(qu)域,設(she)立(li)標識(shi),發布公告,開(kai)展(zhan)土壤、地(di)(di)(di)(di)表(biao)水、地(di)(di)(di)(di)下水、空氣環境(jing)監測(ce);發現污(wu)(wu)染(ran)(ran)擴散的(de)(de)(de),有(you)關(guan)責(ze)任(ren)主(zhu)體要(yao)及時采取污(wu)(wu)染(ran)(ran)物隔(ge)離、阻斷等環境(jing)風險管(guan)控措(cuo)施。(國(guo)土資源部(bu)牽頭,環境(jing)保護部(bu)、住(zhu)房城鄉建設(she)部(bu)、水利(li)(li)部(bu)等參與)

  (十三)落實監管(guan)責任。地(di)方(fang)各級(ji)(ji)城(cheng)(cheng)鄉(xiang)規(gui)劃(hua)部門(men)要結合(he)土(tu)壤環境(jing)(jing)(jing)質量狀況(kuang),加強(qiang)(qiang)城(cheng)(cheng)鄉(xiang)規(gui)劃(hua)論證和審批管(guan)理。地(di)方(fang)各級(ji)(ji)國土(tu)資源部門(men)要依(yi)據土(tu)地(di)利用總體(ti)規(gui)劃(hua)、城(cheng)(cheng)鄉(xiang)規(gui)劃(hua)和地(di)塊土(tu)壤環境(jing)(jing)(jing)質量狀況(kuang),加強(qiang)(qiang)土(tu)地(di)征收(shou)、收(shou)回、收(shou)購以及轉讓、改(gai)變用途(tu)等環節的(de)監管(guan)。地(di)方(fang)各級(ji)(ji)環境(jing)(jing)(jing)保護(hu)部門(men)要加強(qiang)(qiang)對建(jian)設用地(di)土(tu)壤環境(jing)(jing)(jing)狀況(kuang)調查、風險評估(gu)和污(wu)染地(di)塊治理與修(xiu)復活動的(de)監管(guan)。建(jian)立(li)城(cheng)(cheng)鄉(xiang)規(gui)劃(hua)、國土(tu)資源、環境(jing)(jing)(jing)保護(hu)等部門(men)間的(de)信息溝(gou)通機(ji)制(zhi),實行聯動監管(guan)。(國土(tu)資源部、環境(jing)(jing)(jing)保護(hu)部、住房城(cheng)(cheng)鄉(xiang)建(jian)設部負責)

  (十四)嚴(yan)格用(yong)地(di)(di)(di)準入。將建設(she)用(yong)地(di)(di)(di)土(tu)壤環境管(guan)理(li)要求納(na)入城市(shi)規(gui)劃(hua)和供地(di)(di)(di)管(guan)理(li),土(tu)地(di)(di)(di)開(kai)發利用(yong)必須符合土(tu)壤環境質(zhi)量要求。地(di)(di)(di)方各級國(guo)土(tu)資源(yuan)、城鄉規(gui)劃(hua)等部(bu)門在編(bian)制(zhi)土(tu)地(di)(di)(di)利用(yong)總(zong)體(ti)規(gui)劃(hua)、城市(shi)總(zong)體(ti)規(gui)劃(hua)、控制(zhi)性詳細規(gui)劃(hua)等相關規(gui)劃(hua)時,應充(chong)分考慮污染(ran)地(di)(di)(di)塊(kuai)的環境風險,合理(li)確定土(tu)地(di)(di)(di)用(yong)途。(國(guo)土(tu)資源(yuan)部(bu)、住(zhu)房城鄉建設(she)部(bu)牽頭,環境保護(hu)部(bu)參(can)與)

   五、強化未污(wu)染(ran)土(tu)壤保護,嚴控新增土(tu)壤污(wu)染(ran)

  (十(shi)五)加(jia)強未利用(yong)(yong)(yong)地(di)環境(jing)管(guan)理。按照科學有(you)序原則開(kai)發利用(yong)(yong)(yong)未利用(yong)(yong)(yong)地(di),防止造成土(tu)壤污(wu)染。擬開(kai)發為農(nong)用(yong)(yong)(yong)地(di)的(de)(de),有(you)關(guan)縣(市(shi)、區)人民政府要(yao)組織開(kai)展土(tu)壤環境(jing)質量狀況評(ping)估(gu);不符合相應標準的(de)(de),不得種植食用(yong)(yong)(yong)農(nong)產(chan)品。各地(di)要(yao)加(jia)強納入耕地(di)后備資源(yuan)的(de)(de)未利用(yong)(yong)(yong)地(di)保護,定期開(kai)展巡(xun)查。依法(fa)嚴查向(xiang)沙漠、灘涂(tu)、鹽堿地(di)、沼(zhao)澤地(di)等(deng)非法(fa)排(pai)污(wu)、傾(qing)倒有(you)毒(du)有(you)害物質的(de)(de)環境(jing)違法(fa)行為。加(jia)強對礦(kuang)山、油田等(deng)礦(kuang)產(chan)資源(yuan)開(kai)采(cai)活動影響區域內(nei)未利用(yong)(yong)(yong)地(di)的(de)(de)環境(jing)監管(guan),發現土(tu)壤污(wu)染問題的(de)(de),要(yao)及時(shi)督促有(you)關(guan)企業(ye)采(cai)取防治措(cuo)施。推動鹽堿地(di)土(tu)壤改(gai)良(liang),自2017年起,在新疆生產(chan)建設(she)兵團等(deng)地(di)開(kai)展利用(yong)(yong)(yong)燃煤電廠(chang)脫硫石(shi)膏(gao)改(gai)良(liang)鹽堿地(di)試點(dian)。(環境(jing)保護部(bu)、國(guo)(guo)土(tu)資源(yuan)部(bu)牽頭(tou),國(guo)(guo)家(jia)發展改(gai)革委、公(gong)安部(bu)、水利部(bu)、農(nong)業(ye)部(bu)、國(guo)(guo)家(jia)林業(ye)局(ju)等(deng)參與(yu))

  (十六)防范建設(she)用(yong)地新(xin)增(zeng)污(wu)(wu)染(ran)(ran)。排放(fang)重(zhong)點(dian)污(wu)(wu)染(ran)(ran)物的建設(she)項目,在開展環(huan)境影響評價時(shi),要(yao)(yao)增(zeng)加對(dui)土(tu)壤環(huan)境影響的評價內(nei)容,并提出防范土(tu)壤污(wu)(wu)染(ran)(ran)的具(ju)體(ti)措(cuo)施(shi)(shi);需要(yao)(yao)建設(she)的土(tu)壤污(wu)(wu)染(ran)(ran)防治設(she)施(shi)(shi),要(yao)(yao)與主體(ti)工程同時(shi)設(she)計、同時(shi)施(shi)(shi)工、同時(shi)投(tou)產使(shi)用(yong);有關(guan)環(huan)境保護部(bu)門(men)要(yao)(yao)做好有關(guan)措(cuo)施(shi)(shi)落實(shi)情況的監督(du)管理工作(zuo)。自(zi)2017年(nian)起,有關(guan)地方人民政府要(yao)(yao)與重(zhong)點(dian)行業企業簽訂土(tu)壤污(wu)(wu)染(ran)(ran)防治責任書,明確相關(guan)措(cuo)施(shi)(shi)和(he)責任,責任書向社會公(gong)開。(環(huan)境保護部(bu)負責)

  (十七(qi))強(qiang)化空(kong)間(jian)布(bu)局管(guan)控。加(jia)強(qiang)規劃(hua)區(qu)劃(hua)和建(jian)設項目(mu)布(bu)局論證,根據(ju)土壤等(deng)環境承載能力,合(he)理(li)確定(ding)(ding)區(qu)域功能定(ding)(ding)位(wei)、空(kong)間(jian)布(bu)局。鼓勵工業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)集(ji)(ji)聚(ju)發展,提高土地節約集(ji)(ji)約利用(yong)水平,減少土壤污(wu)染。嚴(yan)格執行(xing)(xing)相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye)布(bu)局選址(zhi)要(yao)求,禁止在居民區(qu)、學(xue)(xue)校、醫療和養老機(ji)構等(deng)周邊新(xin)(xin)建(jian)有(you)色金屬(shu)冶煉、焦化等(deng)行(xing)(xing)業(ye)(ye)(ye)(ye)企業(ye)(ye)(ye)(ye);結合(he)推進新(xin)(xin)型城鎮(zhen)化、產(chan)業(ye)(ye)(ye)(ye)結構調整和化解(jie)過剩產(chan)能等(deng),有(you)序搬遷或依法關(guan)(guan)閉對土壤造成嚴(yan)重污(wu)染的現有(you)企業(ye)(ye)(ye)(ye)。結合(he)區(qu)域功能定(ding)(ding)位(wei)和土壤污(wu)染防治需(xu)要(yao),科學(xue)(xue)布(bu)局生活垃圾處(chu)理(li)、危險廢物處(chu)置、廢舊資源(yuan)再生利用(yong)等(deng)設施(shi)和場所,合(he)理(li)確定(ding)(ding)畜禽養殖布(bu)局和規模。(國家發展改革委牽頭,工業(ye)(ye)(ye)(ye)和信息(xi)化部、國土資源(yuan)部、環境保護部、住房城鄉建(jian)設部、水利部、農業(ye)(ye)(ye)(ye)部、國家林業(ye)(ye)(ye)(ye)局等(deng)參與)

  六、加強污染源監(jian)管,做好(hao)土壤污染預防工(gong)作

  (十八(ba))嚴(yan)控(kong)工(gong)(gong)礦污(wu)染(ran)(ran)。加強(qiang)日常環(huan)境(jing)(jing)(jing)監管(guan)。各(ge)地要(yao)根據(ju)(ju)工(gong)(gong)礦企(qi)(qi)業(ye)(ye)(ye)分布(bu)(bu)和(he)(he)污(wu)染(ran)(ran)排放情(qing)況,確定土(tu)壤環(huan)境(jing)(jing)(jing)重(zhong)點監管(guan)企(qi)(qi)業(ye)(ye)(ye)名單,實行(xing)動態(tai)更新,并向(xiang)社會(hui)公布(bu)(bu)。列(lie)入名單的企(qi)(qi)業(ye)(ye)(ye)每年(nian)要(yao)自行(xing)對其用(yong)地進(jin)行(xing)土(tu)壤環(huan)境(jing)(jing)(jing)監測,結果(guo)向(xiang)社會(hui)公開。有(you)(you)關環(huan)境(jing)(jing)(jing)保護部(bu)門要(yao)定期對重(zhong)點監管(guan)企(qi)(qi)業(ye)(ye)(ye)和(he)(he)工(gong)(gong)業(ye)(ye)(ye)園(yuan)區周邊開展監測,數據(ju)(ju)及(ji)時(shi)上傳全(quan)國(guo)土(tu)壤環(huan)境(jing)(jing)(jing)信(xin)息化(hua)(hua)管(guan)理平臺(tai),結果(guo)作為環(huan)境(jing)(jing)(jing)執法和(he)(he)風險(xian)預警(jing)的重(zhong)要(yao)依據(ju)(ju)。適時(shi)修(xiu)訂國(guo)家鼓勵的有(you)(you)毒有(you)(you)害(hai)原料(產品(pin)(pin))替代品(pin)(pin)目錄。加強(qiang)電器電子、汽(qi)車等工(gong)(gong)業(ye)(ye)(ye)產品(pin)(pin)中有(you)(you)害(hai)物質(zhi)控(kong)制(zhi)。有(you)(you)色金(jin)屬冶(ye)煉(lian)、石(shi)油加工(gong)(gong)、化(hua)(hua)工(gong)(gong)、焦(jiao)化(hua)(hua)、電鍍、制(zhi)革(ge)等行(xing)業(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)拆(chai)除(chu)生產設施(shi)(shi)設備、構(gou)筑物和(he)(he)污(wu)染(ran)(ran)治(zhi)理設施(shi)(shi),要(yao)事先制(zhi)定殘留污(wu)染(ran)(ran)物清理和(he)(he)安(an)全(quan)處置(zhi)方(fang)案,并報所在地縣級環(huan)境(jing)(jing)(jing)保護、工(gong)(gong)業(ye)(ye)(ye)和(he)(he)信(xin)息化(hua)(hua)部(bu)門備案;要(yao)嚴(yan)格按照有(you)(you)關規(gui)(gui)定實施(shi)(shi)安(an)全(quan)處理處置(zhi),防范拆(chai)除(chu)活動污(wu)染(ran)(ran)土(tu)壤。2017年(nian)底前,發(fa)布(bu)(bu)企(qi)(qi)業(ye)(ye)(ye)拆(chai)除(chu)活動污(wu)染(ran)(ran)防治(zhi)技術規(gui)(gui)定。(環(huan)境(jing)(jing)(jing)保護部(bu)、工(gong)(gong)業(ye)(ye)(ye)和(he)(he)信(xin)息化(hua)(hua)部(bu)負責)

  加(jia)強涉重(zhong)金屬行(xing)業(ye)(ye)(ye)污(wu)染防(fang)控。嚴格執行(xing)重(zhong)金屬污(wu)染物排放標(biao)準(zhun)(zhun)并落實(shi)相(xiang)關總量控制指標(biao),加(jia)大(da)監督檢查力度,對整改后(hou)(hou)仍不達標(biao)的企業(ye)(ye)(ye),依法責(ze)令其停業(ye)(ye)(ye)、關閉,并將企業(ye)(ye)(ye)名單向社會公(gong)開。繼續淘汰(tai)涉重(zhong)金屬重(zhong)點(dian)行(xing)業(ye)(ye)(ye)落后(hou)(hou)產能(neng)(neng),完(wan)善重(zhong)金屬相(xiang)關行(xing)業(ye)(ye)(ye)準(zhun)(zhun)入(ru)條件,禁止新(xin)建(jian)落后(hou)(hou)產能(neng)(neng)或產能(neng)(neng)嚴重(zhong)過(guo)剩(sheng)行(xing)業(ye)(ye)(ye)的建(jian)設項目(mu)。按計(ji)劃逐步淘汰(tai)普通照明白(bai)熾燈。提(ti)高鉛(qian)酸蓄電(dian)池等行(xing)業(ye)(ye)(ye)落后(hou)(hou)產能(neng)(neng)淘汰(tai)標(biao)準(zhun)(zhun),逐步退出(chu)落后(hou)(hou)產能(neng)(neng)。制定涉重(zhong)金屬重(zhong)點(dian)工(gong)業(ye)(ye)(ye)行(xing)業(ye)(ye)(ye)清(qing)潔生產技術推(tui)行(xing)方案,鼓勵企業(ye)(ye)(ye)采用(yong)先進適用(yong)生產工(gong)藝和技術。2020年重(zhong)點(dian)行(xing)業(ye)(ye)(ye)的重(zhong)點(dian)重(zhong)金屬排放量要(yao)比(bi)2013年下降10%。(環境保(bao)護部(bu)(bu)、工(gong)業(ye)(ye)(ye)和信息(xi)化部(bu)(bu)牽頭,國家(jia)發(fa)展改革委(wei)參與)

  強(qiang)化畜(chu)禽(qin)養(yang)(yang)殖(zhi)(zhi)污(wu)染防治。嚴格規(gui)(gui)范獸(shou)藥、飼料添加(jia)劑的生產和使(shi)(shi)用,防止過(guo)量使(shi)(shi)用,促(cu)進源頭減(jian)量。加(jia)強(qiang)畜(chu)禽(qin)糞便(bian)綜合利用,在部(bu)(bu)分(fen)生豬大縣開(kai)展種養(yang)(yang)業(ye)有機結合、循環發(fa)展試點。鼓勵支持畜(chu)禽(qin)糞便(bian)處理(li)利用設(she)施建(jian)設(she),到2020年,規(gui)(gui)模(mo)化養(yang)(yang)殖(zhi)(zhi)場(chang)、養(yang)(yang)殖(zhi)(zhi)小區配套建(jian)設(she)廢(fei)棄物處理(li)設(she)施比例達到75%以上(shang)。(農(nong)業(ye)部(bu)(bu)牽(qian)頭,國家發(fa)展改革委(wei)、環境保護部(bu)(bu)參與)

  加(jia)強灌溉水(shui)(shui)(shui)水(shui)(shui)(shui)質(zhi)管(guan)理。開展灌溉水(shui)(shui)(shui)水(shui)(shui)(shui)質(zhi)監測。灌溉用水(shui)(shui)(shui)應符合農田灌溉水(shui)(shui)(shui)水(shui)(shui)(shui)質(zhi)標準。對(dui)因長期使用污水(shui)(shui)(shui)灌溉導致土(tu)壤(rang)污染嚴重、威(wei)脅農產品質(zhi)量安全的(de),要(yao)及時調整種(zhong)植結構。(水(shui)(shui)(shui)利部牽頭,農業部參與)

  七(qi)、開(kai)展污染治理與修復(fu),改善區域土壤環境質量

  強化治理與修(xiu)復(fu)工(gong)(gong)程監(jian)管。治理與修(xiu)復(fu)工(gong)(gong)程原(yuan)則上在(zai)原(yuan)址進行,并采(cai)取必要(yao)(yao)措(cuo)(cuo)施(shi)防(fang)(fang)止污(wu)染土壤(rang)(rang)挖掘、堆存(cun)等造成二次(ci)污(wu)染;需(xu)要(yao)(yao)轉運污(wu)染土壤(rang)(rang)的(de),有關責(ze)任(ren)(ren)(ren)單位要(yao)(yao)將運輸時間(jian)、方式、線路和污(wu)染土壤(rang)(rang)數量、去(qu)向、最終處置措(cuo)(cuo)施(shi)等,提前向所(suo)在(zai)地和接收地環(huan)(huan)境保(bao)護(hu)部(bu)(bu)門報(bao)告(gao)。工(gong)(gong)程施(shi)工(gong)(gong)期間(jian),責(ze)任(ren)(ren)(ren)單位要(yao)(yao)設(she)立公(gong)(gong)告(gao)牌,公(gong)(gong)開(kai)工(gong)(gong)程基(ji)本情況、環(huan)(huan)境影(ying)響(xiang)及其防(fang)(fang)范措(cuo)(cuo)施(shi);所(suo)在(zai)地環(huan)(huan)境保(bao)護(hu)部(bu)(bu)門要(yao)(yao)對(dui)(dui)各項環(huan)(huan)境保(bao)護(hu)措(cuo)(cuo)施(shi)落實(shi)情況進行檢查(cha)。工(gong)(gong)程完工(gong)(gong)后(hou),責(ze)任(ren)(ren)(ren)單位要(yao)(yao)委托第(di)三方機構對(dui)(dui)治理與修(xiu)復(fu)效果(guo)進行評估,結果(guo)向社會公(gong)(gong)開(kai)。實(shi)行土壤(rang)(rang)污(wu)染治理與修(xiu)復(fu)終身(shen)責(ze)任(ren)(ren)(ren)制(zhi),2017年底前,出(chu)臺有關責(ze)任(ren)(ren)(ren)追究辦法。(環(huan)(huan)境保(bao)護(hu)部(bu)(bu)牽頭,國土資源部(bu)(bu)、住(zhu)房城鄉(xiang)建設(she)部(bu)(bu)、農業部(bu)(bu)參與)

  (二十九(jiu))發(fa)揮市(shi)場作用(yong)。通(tong)過政府(fu)(fu)和社會(hui)(hui)資(zi)本合作(PPP)模式(shi),發(fa)揮財政資(zi)金(jin)撬動(dong)功能,帶動(dong)更多社會(hui)(hui)資(zi)本參與(yu)土(tu)(tu)(tu)壤(rang)(rang)污染(ran)(ran)(ran)防(fang)治(zhi)(zhi)。加大政府(fu)(fu)購買服務力(li)度,推(tui)(tui)動(dong)受污染(ran)(ran)(ran)耕地(di)和以政府(fu)(fu)為責任(ren)主體的污染(ran)(ran)(ran)地(di)塊治(zhi)(zhi)理與(yu)修復(fu)。積極發(fa)展綠(lv)色(se)金(jin)融,發(fa)揮政策性和開發(fa)性金(jin)融機(ji)構引導作用(yong),為重(zhong)大土(tu)(tu)(tu)壤(rang)(rang)污染(ran)(ran)(ran)防(fang)治(zhi)(zhi)項目(mu)提(ti)供支(zhi)持。鼓勵符合條件的土(tu)(tu)(tu)壤(rang)(rang)污染(ran)(ran)(ran)治(zhi)(zhi)理與(yu)修復(fu)企(qi)業(ye)發(fa)行(xing)股票。探索通(tong)過發(fa)行(xing)債券推(tui)(tui)進土(tu)(tu)(tu)壤(rang)(rang)污染(ran)(ran)(ran)治(zhi)(zhi)理與(yu)修復(fu),在土(tu)(tu)(tu)壤(rang)(rang)污染(ran)(ran)(ran)綜合防(fang)治(zhi)(zhi)先行(xing)區開展試點。有序開展重(zhong)點行(xing)業(ye)企(qi)業(ye)環境污染(ran)(ran)(ran)強制責任(ren)保(bao)險試點。(國(guo)家發(fa)展改革委、環境保(bao)護(hu)部牽頭,財政部、人民銀(yin)行(xing)、銀(yin)監會(hui)(hui)、證監會(hui)(hui)、保(bao)監會(hui)(hui)等參與(yu))

  (三十)加(jia)強(qiang)社會(hui)監督。推進信息公(gong)(gong)(gong)開。根據(ju)土壤(rang)環(huan)境質量監測和調查結果,適時發布全國土壤(rang)環(huan)境狀況。各省(區(qu)、市)人民政(zheng)府定期公(gong)(gong)(gong)布本(ben)行(xing)政(zheng)區(qu)域(yu)各地級市(州、盟)土壤(rang)環(huan)境狀況。重點行(xing)業(ye)企業(ye)要依據(ju)有關規定,向社會(hui)公(gong)(gong)(gong)開其(qi)產生(sheng)的污染物名稱、排放方式(shi)、排放濃度、排放總(zong)量,以及污染防治設(she)施建設(she)和運(yun)行(xing)情(qing)況。(環(huan)境保(bao)護部(bu)牽頭,國土資(zi)源部(bu)、住(zhu)房(fang)城(cheng)鄉建設(she)部(bu)、農(nong)業(ye)部(bu)等(deng)參與)

  引(yin)導(dao)公眾參(can)與。實行有獎(jiang)舉報,鼓(gu)勵公眾通過“12369”環(huan)保舉報熱(re)線、信(xin)函、電子郵件、政府網站(zhan)、微信(xin)平臺等(deng)(deng)途徑,對亂排廢(fei)水、廢(fei)氣,亂倒廢(fei)渣、污(wu)泥等(deng)(deng)污(wu)染(ran)(ran)土(tu)壤(rang)的(de)(de)環(huan)境(jing)(jing)違(wei)法行為(wei)進行監(jian)督。有條件的(de)(de)地方(fang)可根(gen)據需要聘請環(huan)境(jing)(jing)保護義務監(jian)督員,參(can)與現場環(huan)境(jing)(jing)執法、土(tu)壤(rang)污(wu)染(ran)(ran)事件調查處理等(deng)(deng)。鼓(gu)勵種(zhong)糧大(da)戶、家庭農(nong)場、農(nong)民合作(zuo)社以及民間環(huan)境(jing)(jing)保護機構參(can)與土(tu)壤(rang)污(wu)染(ran)(ran)防治(zhi)工作(zuo)。(環(huan)境(jing)(jing)保護部(bu)牽頭,國土(tu)資源部(bu)、住房城(cheng)鄉建(jian)設部(bu)、農(nong)業部(bu)等(deng)(deng)參(can)與)

  推動公(gong)(gong)益訴(su)(su)訟(song)。鼓勵(li)依法(fa)對(dui)污染(ran)土(tu)(tu)(tu)壤等環(huan)境(jing)違法(fa)行(xing)為提(ti)起公(gong)(gong)益訴(su)(su)訟(song)。開展檢(jian)察(cha)機(ji)關(guan)提(ti)起公(gong)(gong)益訴(su)(su)訟(song)改(gai)革試點的(de)(de)地(di)區,檢(jian)察(cha)機(ji)關(guan)可以(yi)以(yi)公(gong)(gong)益訴(su)(su)訟(song)人的(de)(de)身份,對(dui)污染(ran)土(tu)(tu)(tu)壤等損害社會公(gong)(gong)共(gong)利(li)益的(de)(de)行(xing)為提(ti)起民事公(gong)(gong)益訴(su)(su)訟(song);也(ye)可以(yi)對(dui)負有土(tu)(tu)(tu)壤污染(ran)防治職(zhi)責的(de)(de)行(xing)政機(ji)關(guan),因違法(fa)行(xing)使職(zhi)權或者不(bu)作為造(zao)成國(guo)家和社會公(gong)(gong)共(gong)利(li)益受到侵害的(de)(de)行(xing)為提(ti)起行(xing)政公(gong)(gong)益訴(su)(su)訟(song)。地(di)方各級人民政府(fu)和有關(guan)部(bu)(bu)門應當積極(ji)配合(he)司法(fa)機(ji)關(guan)的(de)(de)相關(guan)案件辦(ban)理工作和檢(jian)察(cha)機(ji)關(guan)的(de)(de)監(jian)督(du)工作。(最高人民檢(jian)察(cha)院、最高人民法(fa)院牽頭,國(guo)土(tu)(tu)(tu)資源部(bu)(bu)、環(huan)境(jing)保(bao)護部(bu)(bu)、住房城鄉建設(she)部(bu)(bu)、水利(li)部(bu)(bu)、農業部(bu)(bu)、國(guo)家林業局等參(can)與)

  十、加強目標考核,嚴格責任追究

  (三十四)落(luo)實企業責(ze)任。有(you)關(guan)企業要加強(qiang)內部(bu)管(guan)理,將土(tu)壤污(wu)(wu)染防治(zhi)納入環境(jing)風險防控體系(xi),嚴格依法依規建設(she)和(he)運營污(wu)(wu)染治(zhi)理設(she)施(shi),確保重點污(wu)(wu)染物穩定(ding)達(da)標排放(fang)。造(zao)成土(tu)壤污(wu)(wu)染的(de),應承擔損害評估、治(zhi)理與修復的(de)法律(lv)責(ze)任。逐步建立土(tu)壤污(wu)(wu)染治(zhi)理與修復企業行業自律(lv)機制(zhi)。國有(you)企業特別(bie)是中央企業要帶頭落(luo)實。(環境(jing)保護(hu)部(bu)牽頭,工業和(he)信息化(hua)部(bu)、國務院國資委等參與)

  對年度評估結果較(jiao)差或未通過考核(he)的省(區(qu)、市),要(yao)提出限(xian)期整(zheng)改(gai)意見,整(zheng)改(gai)完(wan)成(cheng)前,對有(you)(you)關地區(qu)實施(shi)建設項目環評限(xian)批;整(zheng)改(gai)不到位(wei)的,要(yao)約談(tan)有(you)(you)關省級人民(min)政(zheng)(zheng)(zheng)府及其相(xiang)關部(bu)門負責人。對土(tu)壤(rang)環境(jing)問(wen)題突(tu)出、區(qu)域土(tu)壤(rang)環境(jing)質量明顯下降、防治工作不力、群眾反(fan)映強烈(lie)的地區(qu),要(yao)約談(tan)有(you)(you)關地市級人民(min)政(zheng)(zheng)(zheng)府和省級人民(min)政(zheng)(zheng)(zheng)府相(xiang)關部(bu)門主要(yao)負責人。對失職(zhi)瀆(du)職(zhi)、弄虛作假(jia)的,區(qu)分情(qing)節輕重,予以誡勉、責令(ling)公開道(dao)歉、組(zu)織(zhi)處理或黨紀(ji)(ji)政(zheng)(zheng)(zheng)紀(ji)(ji)處分;對構成(cheng)犯罪(zui)的,要(yao)依法(fa)追(zhui)究刑(xing)事責任,已經調(diao)離、提拔(ba)或者退休的,也要(yao)終身(shen)追(zhui)究責任。(環境(jing)保護部(bu)牽頭,中央(yang)組(zu)織(zhi)部(bu)、監察部(bu)參與)

  我國正處(chu)于全面(mian)建成小康社會決勝階段,提(ti)高環境(jing)質(zhi)量(liang)是人民群(qun)眾的(de)熱切期盼,土壤(rang)污染(ran)防治(zhi)(zhi)任(ren)務艱巨。各地區、各有關部門要認清形勢,堅定(ding)信(xin)心,狠抓落實,切實加(jia)強(qiang)污染(ran)治(zhi)(zhi)理和生(sheng)態保護,如期實現全國土壤(rang)污染(ran)防治(zhi)(zhi)目(mu)標,確保生(sheng)態環境(jing)質(zhi)量(liang)得到改(gai)善、各類(lei)自然生(sheng)態系統安全穩定(ding),為建設美麗中國、實現“兩個一(yi)百年”奮斗目(mu)標和中華(hua)民族偉大(da)復興的(de)中國夢作出貢(gong)獻(xian)。
